The father, if not listed on the birth certificate, does not have any legal rights. The father will not have custody, will not need to pay child support and would not have visitation rights even though the child would biologically be his.
Is it necessary for the father to be present in the hospital to sign the birth certificate?

If the father is absent at the hospital following the childs birth, the mother would not be able to list him as the real father of the child in the birth certificate. Instead, both father and mother would have to sign a voluntary declaration of paternity thereafter and add the fathers name on the certificate.
I don’t have a birth certificate. Is it illegal?

Technically, yes. Though it is not a crime to have a baby off-the-grid in the US, many details related to the event could be illegal. The obstetrician who delivered the child or the licensed midwife should file for a birth certificate legally or they are at risk of losing their legal license and may get a misdemeanor.
